E-MOTION Paris Motorshow General Terms and Conditions
1. Scope
These General Terms and Conditions of Sale (hereinafter the "GTC") apply without restriction or reservation to all transactions concluded between E-MOTION, a simplified joint-stock company with a capital of 1 000,00 €, headquartered at 20 bis rue Louis-Philippe 92200 Neuilly-sur-Seine, registered with the Trade and Companies Register of Nanterre under the number 929 883 395 (hereinafter « E-MOTION »), and any person wishing to make a reservation via the website www.e-motion.racing (hereinafter the « Site »). Any reservation implies prior full acceptance of these GTC. Their purpose is to describe the conditions of booking and payment for the services sold through the Site.
The GTC are accessible at any time on the Site. E-MOTION may modify them at any time. The modified GTC will apply to any reservation made after they are posted online.
The Client declares that they have full legal capacity to engage in and proceed with any booking on the Site.
Sales of products are subject to different conditions.
2. Definitions
The following terms in these GTC have the following meanings :
Client(s) : Refers to both the consumer and professional clients unless otherwise specified.
Consumer client : Refers to any natural person acting for purposes that are outside the scope of their commercial, industrial, artisanal, liberal, or agricultural activities, making a reservation on the Site.
Professional client : Refers to any natural or legal person with the status of a professional making a reservation on the Site for professional purposes.
Parties : refers collectively to the company E-MOTION and the Client.
Service(s) : Refers to the activities available for booking on the Site, notably the driving simulation sessions.
Reservation : Refers to any purchase of a Service made by a Client on the Site.
Site : Refers to the website accessible at www.e-motion.racing.
E-MOTION Stand : Refers to the place of execution of the Reservation located at Paris Expo Porte de Versailles Hall.
User : Refers to any person browsing on the Site.
3. Reservation
3.1 Characteristics of the Services offered
Each Service consists of driving simulation time in minutes. These minutes are indivisible and begin once the simulation starts.
E-MOTION offers the following packages :
INITIATION : 15 min - 12 €
RACER : 15 min - 17 €
HOTLAP - THE GRID : 30 min - 33 €
HOTLAP KARTING – THE GRID : 15 min - 10 €
A -15% discount is applied to the above rates:

For children under 14 years old with proof of age;

For groups of at least 4 people booking the same offer for all participants.
The Client agrees to arrive at least 10 minutes before the session begins.
3.2 Booking Procedure
To book a Service, the Client must go to the Site and follow these steps:

Select "Book your session" and choose a date and time;

Select the number of participants (1 to 10);

Enter the required participant information;

Review the reservation summary;

Click on "Payment" and proceed with the payment.
The Client will receive a confirmation of payment by email or SMS.
The Reservation will only be considered valid after full payment of the price.
Any confirmed Reservation results in the formation of a contract between the Client and E-MOTION.
3.3 Price and paiement
The prices displayed on the Site include VAT and are expressed in euros. Any change in the applicable rate may affect the price of the Services from the date the new rate comes into effect.
The applicable price is the one indicated on the Site at the time the Reservation is made by the Client.
Payments can only be made using the payment methods accepted by the Site.
E-MOTION reserves the right to refuse, suspend, or cancel any Reservation for legitimate reasons, including in the event of payment issues or abnormal or fraudulent reservations. E-MOTION also reserves the right to refuse any Reservation from a Client involved in a previous payment dispute.
E-MOTION reserves the right to request proof of identity from the Client during payment, as well as proof of their authority to commit the company they are representing, if applicable. If the requested documents are not received, E-MOTION reserves the right to cancel or refuse the Reservation concerned.
Late payment by a professional Client will automatically result, from the day after the due date, in the application of late interest equal to three times the legal interest rate, as well as a fixed compensation of 40 euros for recovery costs. If recovery costs exceed this amount, E-MOTION may claim additional compensation by providing proof.
The Client is not entitled to any refund for their Reservation if they fail to appear at the E-MOTION Stand on the day and time of their Reservation, or if they arrive late.
In case of lateness, the Client acknowledges that each minute may be deducted from their Reservation. If their lateness exceeds the reserved time, the Reservation will be considered as fully consumed.
4. Modification of the Reservation / Entering participant details
The Client may request cancellation or modification (date, time, number of participants) of their Reservation directly at the E-MOTION Stand. E-MOTION is not obligated to accept such requests for modification or cancellation. If E-MOTION cannot modify or cancel the Reservation as requested by the Client, the latter will not be entitled to any refund or compensation.
5. Customer Service
For any information, questions, or complaints, Customer Service can be contacted via the contact form available on the Site.
6. Responsibilities
6.1 The Client is responsible for verifying the completeness and accuracy of the information provided when making a Reservation on the Site.
The Client remains responsible for any errors made during the input of their information. E-MOTION cannot be held liable for any such errors.
6.2 The Client must enter their payment information with strict confidentiality and in a secure manner, out of sight of others. The Client must take all necessary precautions to protect this information.
6.3 E-MOTION cannot be held liable for any failure or delay in fulfilling its obligations as described in these GTC due to a force majeure event as defined by Article 1218 of the French Civil Code and applicable case law.
Events that constitute force majeure include, but are not limited to:
- Strikes, wars, riots, revolutions, embargoes;
- Exceptional health or climatic hazards;
- Any kind of event affecting the location of the simulators;
- Epidemics/pandemics, understood as the spread of a disease over the national territory;
- Restrictions on the movement of people or vehicles;
- Failures of any partner or provider, including technical providers involved in the proper functioning of the simulators and online reservations;
- Loss of administrative authorization;
- Computer viruses or cyberattacks;
- Total or partial cancellation of the event due to circumstances beyond E-MOTION's control.
In the event of force majeure, E-MOTION will inform the Client of its inability to fulfill its obligations. The suspension of obligations will not be grounds for liability for non-performance or delay in performance, nor will it result in the payment of damages or late penalties.
The performance of obligations will be suspended for the duration of the force majeure event if it is temporary and does not exceed 24 hours. Once the cause of suspension disappears, E-MOTION will make every effort to resume normal execution of its obligations as quickly as possible.
In any case, E-MOTION's liability cannot be engaged for any damage that does not result directly from a breach of one of its obligations.
7. Intellectual Property
The Site and the elements it contains are the exclusive property of E-MOTION or its partners. Any User of the Site is prohibited from reproducing or exploiting the intellectual property elements contained on the Site without the express prior written consent of E-MOTION.
8. Personal Data
8.1 Opposition to Telephone Solicitation – BLOCTEL
The Client is informed that they can register for free on a list to block telephone solicitation, so they do not receive commercial solicitations.
8.2 Processing of Collected Personal Data
Personal data collected from the Client is processed by E-MOTION. It is recorded in E-MOTION's customer file and is necessary for processing the Reservation. It will be retained for as long as necessary for the execution of the Reservation and to allow E-MOTION to comply with its legal and regulatory obligations.
Access to the Client's personal data is strictly limited to the employees of the data controller authorized to process it by virtue of their duties. The collected information may be communicated to E-MOTION's partners and service providers responsible for executing the Reservation, payment, or invoicing, without the Client's prior authorization. These third parties only have limited access to the data and are obliged to use it in accordance with the applicable data protection legislation.
With the Client's express consent, E-MOTION may send newsletters to the Client, directly or through its subcontractors or partners, to inform them of commercial operations and events organized by E-MOTION. The Client may opt-out of receiving such newsletters by either refusing to give consent when registering or booking on the Site, or by unsubscribing via the link provided in each communication, or in writing to the address indicated below.
Collected data will not be transferred outside the European Union. If it were to be transferred, the Client will be informed, and the safeguards for securing the transfer and processing of data will be specified to the Client.
In accordance with applicable regulations, any individual has the right to access, rectify, delete, and port their data, as well as the right to object to processing for legitimate reasons. 9. Mediation
In accordance with Articles L.612-1 and following of the Consumer Code, the Client may access the mediation services of MOBILIANS, to which E-MOTION subscribes, free of charge:
- By internet at : https://www.mediateur-mobilians.fr, by filling out the appropriate form and providing documents to support their request;
- By email at : mediateur@mediateur-mobilians.fr
- By post to M. le Médiateur de Mobilians, 43 bis route de Vaugirard - CS 80016 -92197 Meudon CEDEX, with supporting documents.
The Client is informed that there is a European platform for online dispute resolution, accessible at the following link: https://ec.europa.eu/consumers/odr/
For the request to be admissible, the Client must meet the following conditions :
- Attempted an amicable resolution of the dispute with E-MOTION by means of a written complaint;
- Submitted the request to the mediator within one year of the written complaint to E-MOTION.
10. Minors
Minors must obtain prior authorization from their parents, guardians, or legal representatives before making a reservation.
They must also be accompanied by an adult at the location where the Reservation is carried out.
11. Rules Applicable and Safety Conditions at the E-MOTION Stand
E-MOTION reserves the right to refuse access to the simulators to anyone whose behavior is incompatible with the planned activity.
The Client is informed that they should not have any medical contraindications to driving.
The Client must comply with all safety rules related to the booked Services, the simulator usage rules, and all instructions provided by instructors during the sessions.
The Client must wear appropriate attire for the reserved activity to ensure their own safety and that of others. Notably, flip-flops and high heels are prohibited. E-MOTION will not be held liable in this regard.
The use of simulators is strictly prohibited:
- For persons under 1.35 meters on "ULTIMATE" simulators;
- For persons over 1.35 meters on "KARTING" simulators;
- For persons with heart conditions;
- For persons with epilepsy.
Simulators are not recommended for people suffering from motion sickness, nausea, dizziness, or for pregnant women.
The availability of the simulator may be canceled or interrupted at any time if safety or hygiene conditions are no longer met.
In the event of non-compliance with instructions, E-MOTION cannot be held liable in any way.
Any breach may result in the cancellation of the Client's Reservation without any refund or compensation.
12. Applicable Law and Competent Jurisdiction
These GTC, the Reservation, and all resulting acts will be interpreted and executed in accordance with French law.
The parties are invited to seek an amicable agreement before any legal proceedings. For any claim, the Client can contact E-MOTION using the contact details indicated in Article 5. The consumer Client can use mediation under the conditions of Article 9.
Failing an amicable resolution, any dispute of any kind related to the Reservation or these GTC will fall under the exclusive jurisdiction of the French courts.
